1. Agreement between you and Sentry

These Terms of Service ("Terms") form a binding legal agreement between you ("you," "Customer") and Auctus Fortis Enterprises LLC, a Wyoming limited liability company doing business as Sentry ("Sentry," "we," "us," or "our"), that governs your access to and use of the website at sentryclear.com (the "Site") and the purchase of any products from Sentry (the "Products").

By visiting the Site, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, our Refund & Return Policy, and our Shipping Policy. If you do not agree, please do not use the Site or place an order.

2. Eligibility

To use the Site or place an order, you must:

  • Be at least 18 years of age
  • Be a resident of the United States with a valid U.S. shipping and billing address
  • Have the legal capacity to enter into a binding contract
  • Not have been previously suspended or removed from the Site

If you are between 13 and 17 years of age, a parent or legal guardian must place the order on your behalf and accept these Terms. We do not knowingly accept orders from anyone under 13.

3. Account registration

You may browse and purchase from the Site without creating an account, but creating an account makes order tracking, support, and reordering easier. If you choose to create an account:

  • You must provide accurate, current, and complete information
  • You are responsible for keeping your password confidential
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately at support@sentryclear.com if you suspect unauthorized use of your account

We reserve the right to refuse service, terminate accounts, cancel orders, or remove or edit content if we believe a Customer has violated these Terms.

4. Product information and availability

We make every effort to display Sentry products and their features accurately, including photographs, specifications, and descriptions. However:

  • Colors may appear slightly different on different screens due to monitor settings
  • Specifications (sensor models, recording resolutions, storage compatibility) are accurate at the time of listing but may be updated by the manufacturer; the most current spec is the one on the product packaging at time of shipment
  • Stock availability is shown on each product page and updated regularly. If a product becomes unavailable after you order it, we will notify you within 2 business days and offer a full refund or a backorder option

We reserve the right to limit quantities, refuse orders, or discontinue any product at any time.

5. Pricing, payment, and order acceptance

Pricing

  • All prices on the Site are displayed in U.S. Dollars (USD)
  • Prices do not include applicable U.S. state and local sales tax, which is calculated at checkout based on your shipping address and shown as a separate line item before you submit payment
  • Free standard shipping is included on all orders (see Shipping Policy)
  • The total price you see on the final checkout review screen — product price plus any applicable sales tax — is the total amount that will be charged. There are no hidden fees, surcharges, or recurring charges
  • Prices are subject to change without notice, but a price change will never affect an order that has already been confirmed

Payment

  • We accept payment via credit card, debit card, Shop Pay, Apple Pay, Google Pay, and PayPal (subject to availability through our payment processor)
  • Payment is processed at the time the order is placed, through Shopify Payments and similar PCI-DSS-compliant processors. Your card details are never stored on our servers
  • If your payment is declined, your order will not be processed and you will be prompted to use a different payment method
  • You represent that you are authorized to use the payment method you provide

Order acceptance

  • An order is not accepted until we send you an order confirmation email
  • Even after the order confirmation email, we reserve the right to cancel any order in cases of: pricing or product errors, suspected fraud, payment-method issues, or shipping addresses we cannot serve (see Shipping Policy, Section 1)
  • If we cancel an order after charging your payment method, we will refund the full amount within 5 business days

No bait-and-switch

The product, price, and terms shown at the time you place your order are exactly what you receive. We do not change pricing, swap products, or add fees after you submit an order.

6. Sales tax

We collect U.S. state and local sales tax in jurisdictions where Sentry has a tax obligation, calculated automatically at checkout based on your shipping address. The amount of tax is shown clearly on the checkout review screen and on your receipt.

You are responsible for any use tax that may apply if your state requires it and we have not collected it on your purchase.

7. Shipping

All orders ship from our U.S. fulfillment facility in Hillsborough, NJ. Processing time, transit time, carriers, and other shipping details are governed by our Shipping Policy, which is incorporated into these Terms by reference.

8. Returns and refunds

Returns, refunds, exchanges, cancellations, damaged-item handling, and warranty claims are governed by our Refund & Return Policy, which is incorporated into these Terms by reference.

9. Limited product warranty

Sentry products are covered by a one-year limited manufacturer warranty from the date of delivery against defects in materials and workmanship under normal use, in accordance with the warranty terms shipped with each product.

The warranty does not cover:

  • Damage caused by accident, misuse, abuse, or improper installation
  • Damage caused by exposure to extreme temperatures, water, or impact beyond the product's rated tolerances
  • Cosmetic damage that does not affect functionality
  • Products with removed, defaced, or altered serial numbers
  • Normal wear and tear of accessories (cables, mounts, suction cups)

To make a warranty claim, email support@sentryclear.com with your order number, a description of the issue, and photos or video. Approved warranty claims will be resolved by repair, replacement, or refund at our discretion.

This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

10. Intended use of Sentry products — important

Sentry dashcams are designed and sold exclusively for the following lawful purposes:

  • Recording video evidence of road traffic and accidents involving the user's own vehicle
  • Documenting events for insurance claims, legal proceedings, and personal safety
  • Monitoring the user's own parked vehicle (parking mode)
  • Coaching and training of fleet drivers operating commercial vehicles owned or authorized by the fleet operator
  • Personal-safety recording in rideshare and delivery driver contexts (subject to applicable notice and consent laws)

Sentry products are not designed, sold, or licensed for, and you agree not to use Sentry products for, any of the following:

  • Covert surveillance of any person without their knowledge or consent
  • Tracking or monitoring another person, vehicle, or property that you do not own or are not legally authorized to monitor
  • Eavesdropping or recording private conversations in violation of any federal, state, or local law
  • Stalking, harassment, intimate-partner surveillance, or any other unlawful purpose
  • Installation in a vehicle you do not own or have not been authorized to equip with a recording device

Audio-recording laws vary by state

Many U.S. states have audio-recording laws that require all parties to a conversation to consent to being recorded ("two-party consent" or "all-party consent" states), including but not limited to California, Florida, Illinois, Massachusetts, Pennsylvania, and Washington. Other states require only one party to consent. You are solely responsible for understanding and complying with the audio-recording laws of the state in which you operate the Sentry product. If your dashcam includes audio recording, you may wish to disable it or post visible notice to vehicle occupants depending on your jurisdiction.

You agree to indemnify and hold Sentry harmless from any claim arising from your use of a Sentry product in violation of this Section 10 (see Section 17).

11. Acceptable use of the Site

When you use the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, our servers, or any account that is not yours
  • Interfere with or disrupt the Site, including via denial-of-service attacks, scraping at high volume, or attempts to overload the system
  • Reverse engineer, decompile, or disassemble any portion of the Site
  • Use bots, crawlers, or automated tools to access the Site except for legitimate search engine indexing
  • Submit false, misleading, or fraudulent information when placing an order or contacting support
  • Use the Site to transmit any viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Resell Sentry products without our prior written authorization

We may, without notice, suspend or terminate your access to the Site if we believe you have violated this section.

12. Intellectual property

All content on the Site — including but not limited to product photographs, product descriptions, the Sentry name and logo, page layout, and original copy — is the property of Auctus Fortis Enterprises LLC or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may:

  • View, download, and print pages from the Site for your own personal, non-commercial use
  • Share links to product pages and our policy pages

You may not:

  • Reproduce, copy, sell, resell, or commercially exploit any portion of the Site without our prior written consent
  • Use the Sentry name, logo, or any product photography in your own commercial materials without our prior written consent
  • Frame, mirror, or otherwise embed any portion of the Site in another website

If you submit photos, videos, reviews, or other content to us (for example, in a customer testimonial), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with our marketing of Sentry products. You confirm that the content is yours to share and does not violate the rights of any third party.

13. User-submitted content

If you submit a product review, comment, photograph, video, or any other content to the Site (collectively, "User Content"):

  • You represent that the User Content is your own original work, that you have the right to share it, and that it does not infringe any third party's rights
  • You will not submit User Content that is unlawful, defamatory, harassing, threatening, obscene, hateful, or otherwise objectionable
  • We reserve the right (but not the obligation) to review, edit, or remove User Content at any time, for any reason, without notice
  • We are not liable for any User Content submitted by you or any other user

14. Promotions, discounts, and gift cards

From time to time, we may offer promotions, discount codes, or gift cards. Each promotion is governed by its own terms, which we will display at the time of the offer. Unless stated otherwise:

  • Discount codes apply to a single order and cannot be combined with other offers
  • Discount codes have an expiration date and cannot be redeemed after that date
  • Discount codes have no cash value and cannot be exchanged for cash
  • We reserve the right to cancel or modify any promotion at any time, except for promotions already redeemed

We do not run fake countdowns, fake stock-scarcity widgets, or false-urgency mechanisms. Any discount or promotion you see on the Site is real and the terms are exactly as stated.

15. Disclaimers

THE SITE AND THE PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, EXCEPT AS EXPRESSLY PROVIDED IN OUR LIMITED PRODUCT WARRANTY (SECTION 9) AND AS REQUIRED BY APPLICABLE LAW. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENTRY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, error-free, or completely secure
  • Defects on the Site will be corrected immediately
  • The Site or its servers are free of viruses or other harmful components
  • The results obtained from using the Site or the Products will meet your expectations

Some states do not allow the disclaimer of implied warranties, so the above disclaimer may not apply to you in full. In such states, our liability is limited to the maximum extent permitted by law.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SENTRY, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF USE, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE PRODUCTS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you in full.

17. Indemnification

You agree to defend, indemnify, and hold harmless Auctus Fortis Enterprises LLC, its officers, members, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Site or any Sentry Product
  • Your violation of these Terms
  • Your violation of any applicable law, including audio-recording, surveillance, or privacy laws (see Section 10)
  • Your violation of any third party's rights, including intellectual property or privacy rights

18. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Federal law applies where it preempts state law.

19. Dispute resolution and arbitration

Informal resolution first

If you have a dispute with Sentry, please contact us first at support@sentryclear.com. Most issues can be resolved quickly and informally.

Binding individual arbitration

If we cannot resolve a dispute informally within 60 days, any claim or dispute arising out of or relating to these Terms, the Site, or any Sentry Product will be resolved by binding individual arbitration, not in court, except as set out below. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in or remotely from the State of Wyoming, or another reasonably convenient location agreed by the parties.

Class-action waiver

You and Sentry agree that any claim will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions

The following types of disputes are not subject to mandatory arbitration:

  • Small-claims-court disputes that qualify under the rules of the relevant court
  • Claims for injunctive relief related to intellectual property
  • Disputes that may not be arbitrated as a matter of applicable law

Opt-out

You may opt out of the arbitration agreement and class-action waiver in this Section 19 by emailing us at support@sentryclear.com with the subject line "Arbitration Opt-Out" and your full name and order number, within 30 days of your first order. Opting out will not affect any other provision of these Terms.

20. Changes to these Terms

We may update these Terms from time to time. When we do:

  • We will update the "Last updated" date at the top of this page
  • For material changes, we will notify you by email (if you have an account) or by a prominent notice on the Site at least 7 days before the change takes effect
  • Your continued use of the Site or placement of new orders after the change takes effect means you agree to the updated Terms

If you do not agree to the updated Terms, you must stop using the Site.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.

22. No waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by us.

23. Entire agreement

These Terms, together with our Privacy Policy, our Refund & Return Policy, our Shipping Policy, and any product-specific terms or warranties, constitute the entire agreement between you and Sentry regarding the Site and the Products. They supersede any prior agreement on these subjects.

24. Statutory rights disclaimer

These Terms do not affect your statutory rights under applicable consumer protection law, including state and federal law in the United States.
